Property Pages will take all reasonable steps to ensure material uploaded by users complies with the Publishing Guide that forms part of these Terms and Conditions and takes no responsibility for any harm caused by the publication of any material by users.

No Warranties/ Disclaimer

In using this site you expressly understand and agree that:

    1. Your use of the Site is at your sole risk. To the maximum extent permitted by law, Property Pages disclaims and excludes all implied conditions or warranties, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, and non-infringement;
    2. No advice or information that is obtained by you from the Site or Property Pages or anyone else shall create any warranty by Property Pages that is not expressly stated in these terms and conditions;
    3. Property Pages does not make any warranties in respect of the Businesses featured or recommended on this Site or the services performed by those Businesses;
    4. Property Pages does not warrant the accuracy, adequacy, quality, currency, validity, completeness, or suitability of the Services or any other information available on this Site for any purpose. The Site and Services are provided on an “as is” and “as available” basis;
    5. Property Pages does not warrant that the Services provided will be uninterrupted, timely, secure, or error-free, or that any information (including feedback) provided on the Site is accurate, error-free, or reliable;
    6. Property Pages does not warrant that this Site and the Services will be free of infection by viruses, worms, trojan horses, or anything else containing destructive properties;
    7. Property Pages does not necessarily endorse, support, sanction, encourage, verify or agree with the ratings and/or comments posted by users of the Site;
    8. Responsibility for the content of advertisements appearing on this website (including hyperlinks to advertisers’ own websites) rests solely with the advertisers. The placement of such advertisements on the website does not constitute Property Pages’ recommendation or endorsement of the advertised product or service. Each advertiser is solely responsible for any representation made in connection with its advertisement.
    9. In no event shall we be liable for any loss sustained by you arising out of or in connection with the use or performance of this Site by you or others, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss whether at law or in tort or otherwise.
    10. Property Pages is not responsible for the contents of any linked third-party site. We do not imply any endorsement of links from and to this Site except where expressly stated.
    11. Property Pages does not make any representation or provide any warranty or guarantee in respect of any user of the Website including, but not limited to, any representation or warranty in respect of the suitability, behavioural characteristics of or creditworthiness of any user of the website and associated services.
    12. Property Pages is not in any way responsible for the actions, conduct, or speech of any user in using the website and associated services. Further, Property Pages is not an agent or representative for any user, nor does it guarantee or endorse the lawfulness or truth of any words, actions, or speech taken by any user.
    13. By using the website, you understand that you are solely and wholly responsible for your actions, conduct, and speech communicated on or otherwise affecting the website and associated services and the experience of any other user in using the website and associated services.
    14. Property Pages is not liable for any losses incurred as a result of the actions, conduct, or speech of any user of the website or associated services.

Terms of Use - Businesses

These terms apply to anyone who pays to display their business on Property Pages such as local businesses that appear on local searches, and trades or service providers. Breach of these terms may result in the withdrawal of the benefits of registration or the removal of any listings from the Site at our sole discretion.

General

Property Pages is not your agent and is not involved, on behalf of either you or your customers, in any dealings resulting from the use of our products or services. You are solely responsible for any risks associated with your dealings with your customers, and you must communicate and deal with them directly to complete transactions or resolve problems. Further:

  1. You agree to abide by the Publishing Rules for Users;
  2. You agree not to disclose your login details to third parties. If you do so, you are liable for any breach of these terms and conditions by third parties using your login details and the indemnity referred to in clause 7 below is extended accordingly;
  3. You acknowledge and accept that Property Pages is entitled to withdraw the benefits of registration or to remove your Business from the Site in the event of non-payment by you;
  4. You acknowledge that Property Pages may increase or reduce its charges for registered Businesses and that 30 days notice in writing and/or alteration of the charges in these terms and conditions shall be adequate notice to you;
  5. You agree to indemnify Property Pages and its employees, contractors, agents and representatives and to hold them harmless from any and all claims and liabilities (including fees) which may arise from your breach of these terms and conditions.

Property Pages Connect (leads and jobs to your phone)

Links to available work are sent to the mobile number provided by you. “Jobs” are from customers wanting work done immediately or soon and “Quotes” may be for work now or in the future. Both are shown on a job page and are referred to collectively as “Connections” below. By participating in Property Pages Connect you agree that:

  1. Participation in Property Pages Connect may be canceled at any time by either party. You must notify Property Pages if you no longer wish to participate.
  2. You accept a connection if you enter a comment on the job page. There is no obligation to accept a connection. 
  3. Jobs will be assigned to only one tradesperson. Quotes may be assigned to more than one tradesperson.
  4. Accepting a connection requires you to establish contact with the customer within 1 calendar day.
  5. A success fee of $18 will be invoiced on completion of the work as described on the job page.

 

Pages and Listings

Pages contain information such as contact details and descriptions. Listings are pages displayed on the website. Listings may be free or paid. All pages require a paid setup, the cost of which varies with the amount of information added to them.

Pages on a paid listing must be claimed to activate that listing. Any page that remains unclaimed for one month may be removed at the discretion of Property Pages.

Cancellations and Refunds

You may cancel any subscription at any time and agree that:

  1. A cancelled subscription due to a breach of these terms will be refunded at the sole discretion of Property Pages;
  2. A discounted subscription that is longer than 1 month, and that is cancelled prior to its end date, will have unused months refunded based on usage at the normal monthly rate. For example, if a 12-month discounted subscription was cancelled with 5 months remaining, the user will be charged 7 months at the normal monthly rate. The difference between that cost and the amount charged for the 12-month term will be refunded.
  3. Monthly subscriptions are not refunded for unused parts of a month.

Reviews, Ratings and Comments

  1. You acknowledge that listing on Property Pages allows your customers to post reviews, ratings (number of stars out of 5), and comments on you. Individual ratings, average rating, and comments are publicly available on your listing.
  2. You may reply to a review within the first 12 months of the review being posted. Replies to reviews cannot be edited once posted, except at the sole discretion of Property Pages.
  3. You agree not to post, or to encourage or procure others to post, ratings and/or comments about your Business on the Site which are untrue, inaccurate or misleading.
  4. You agree to not coerce or intimidate to acquire or change ratings or comments about your Business and you understand that such activity may result in the removal of your Business from the Site.
  5. Property Pages reserves the right to audit ratings to ensure their legitimacy. When an audit is undertaken raters will be asked to provide evidence of work carried out. Ratings may be temporarily removed during this process.
  6. Your listing will be removed from Property Pages if your average rating falls below 3 stars.
  7. You may appeal to Property Pages to investigate any unfair rating or comment within 12 months of the rating or comment being published. Each investigation costs $90 plus GST regardless of the outcome.
  8. Ratings and comments may be removed at the sole discretion of Property Pages.
  9. Trades and Service businesses require reviews to list and have 7 days to gain the first one. If no review has been given within this time the listing will be withdrawn.
  10. Trades and Service businesses receive 1 month of free listing for every review (star rating) published on their page. 

Publishing Guide for Users

This guide applies to anyone posting a listing, article, advertisement, comment, or FAQ.

General

You may post articles, advertisements, FAQs, reviews, comments, photos, videos, and other content; send communications; and submit suggestions, ideas, questions, or other information, provided the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of messages or content. Property Pages reserves the right to remove or edit any content but does not regularly review posted content.

Leaving Ratings and Comments

  1. Property Pages provides a forum in which Businesses can be rated by their customers. In posting such ratings and/or comments, you warrant that you have engaged this business to work for you and:
    1. The statements of fact reflected in the ratings and/or comments posted by you are truthful;
    2. The opinions reflected in the ratings and/or comments posted by you are genuine and honestly held by you;
    3. You agree to follow the Publishing Guidelines for Users set out in these Terms;
    4. The work reviewed was completed within the 12 months prior to posting the review or within the warranty period offered by the business for the work completed. Evidence may be requested to verify the time frame.

        2. Irrespective of any monitoring of ratings, comments or other content on the Site which Property Pages may choose to undertake, Property Pages shall not be responsible for screening, editorial, or other control over ratings, comments or other content and you acknowledge that the Site may include material that could be deemed distasteful, misleading, inaccurate, offensive, or otherwise objectionable.

Flat or Rental Property Listings

 

Property Pages has sole discretion over the publishing of listings and may modify or remove them at any time.
Property Pages is not a party to, or bound by, the terms of any contractual relationship, including but not limited to a Residential Tenancy Agreement, between a property owner and a tenant. Responsibility for compliance ultimately remains with property owners and tenants. Property owners and tenants should review the relevant laws and regulations for their property type and local area, including local government planning regulations, and seek independent legal advice or other professional advice before leasing or renting their property.

In accordance with the Healthy Homes Standards regulations, from 1st July 2021, all private landlords must ensure that their rental properties comply with HHS within 90 days of any new tenancy. This includes requirements for:

  • Insulation
  • Ventilation
  • Heating
  • Draught Stopping
  • Moisture Control
When listing a Flat or Rental Property Listing, a landlord may indicate compliance with the Healthy Home Standards. Property Pages is not responsible for the accuracy of such indications. Property Pages in no way guarantees, warrants, or certifies the quality or condition of any property. Property Pages does not conduct any inspections or other checks of any property that is listed through the website.

Property owners and tenants must comply with the terms of the agreement between them, which may include, but are not limited to, the following laws:

  • Residential Tenancies Act 1986
  • Unit Titles Act 2010
  • Building Act 2004
  • Consumer Guarantees Act 1993
  • Fair Trading Act 1986
  • Privacy Act 2020

Property Pages does not check in any way any user of the website, including those who are property owners, tenants, or prospective tenants. Further, Property Pages does not in any way warrant or guarantee the accuracy of any user’s identity in using the website.

By using the website you:

  • Agree to abide by any and all laws, including, but not limited to, residential tenancy laws, planning and building laws and regulations, and local government regulations and by-laws.
  • Agree to use your true and actual identity at all times when using the website and interacting with any other user.
  • Agree that you are solely responsible for the management of any tenancy that is managed through the website and associated services.
  • Agree that any and all information or other content that you upload or otherwise supply to the Website and associated services, Property Pages, or any other user is true and correct. If any such information changes, you must notify any affected other user as soon as reasonably practicable.
 

Publishing Articles and FAQs

Industry Articles

Articles and FAQs are submitted for approval before publication. Ensure that the core content is for the sole benefit of Property Pages visitors and is not an “advertorial”.  Reference to your company and the services you provide should be removed from headings and body text. Property Pages reserves the right to remove such references and make edits as necessary. If there are too many references to your company or your services the article will not be published.

We will provide a link to your company website through the logo you provide on the listing form. A URL to your company website page that has a backlink to https://www.propertypages.co.nz must be entered on the listing form before publication.

Property Pages assumes no responsibility or liability for the preservation of content on the Site and may modify or remove it at its sole discretion.

Articles are contributed on a yearly subscription which may be canceled at any time and will be refunded pro-rata, less the account setup fee of $290.

Local Knowledge Articles

Local Knowledge articles describe a neighbourhood or area and will be published at the sole discretion of Property Pages. There is no charge to publish Local Knowledge articles on Property Pages. 

Local Knowledge articles are submitted for approval before publication. The core content must be for the sole benefit of Property Pages visitors and not an “advertorial” for any local business. Such articles will not be published. Contributors may wish to link to a company website. In this case, a backlink from the company website is required. Anyone can add a New Local Knowledge Article by creating an account here

Attribution and Permission

Property Pages will attribute any article to its original author and will provide a link to the original content. We will also provide a “no index” tag so that the SEO metrics of the originating website will not be adversely affected.

You may want to include, or refer to, something that has been written by someone else. While it’s possible to copy a phrase or a few words without violating copyright laws, if you quote someone, please attribute the source where that quote came from to remain within the rules of fair use. You should do this by citing the original author’s name and where the quote was originally used. Ask permission where possible.

Asking permission also applies to the use of photos and images. Unless a photo or image you plan to use comes from a source that clearly gives permission for you to use it, you must ask the original photographer or designer for permission to use it with proper attribution.

Disclosure
  1. Disclose any affiliates who benefit from your article and explain your relationship with them.
  2. Don’t pretend to be an objective third party if you’re not. If you work for a company, state that fact in any content that refers to it or its products or services.

Uploading Images

 
Unacceptable Images
  • Images that are do not belong to you.
  • Objectionable images. These include, but are not limited to, obscene, violent, racist, sexist, disparaging, or defamatory images.

Content that is outside these guidelines will result in immediate removal of the listing and possible revocation of publishing rights on Property Pages.

Photo sizes
Article Header Image: Photos need to be a minimum of 800 pixels on the longest side in order to show correctly. We take care of the smaller versions.

Advertiser Header Image: Photos need to be a minimum of 1600 pixels on the longest side in order to show correctly. The higher the quality of photo, the better the experience of those who see it. Images that have file sizes that are too large will be rejected.

What are pixels?

The word ‘pixel’ means a picture element and they are the smallest unit of information that makes up a picture – every photograph in digital form is made up of pixels. The more pixels you have, the more closely the photo resembles the original thing you have taken a photo of. The more pixels you have, the clearer the zoom quality will be.

How can I check if my current photos are the right size?

Use right-click on your computer to check the info of your file. Alternatively, simply upload your image (s) and check in the live preview. Uploading a better image will replace the existing headshot, logo, or header image.

What are the specifications for photos?
  • Photo file format: .gif, .bmp, .png, .jpeg or .jpg format.
  • Photo file size limit: under 1MB.
  • Photo quality: For Article Header Images, at least 800 pixels or more on the longest side. For Advertiser Header Images, at least 1600 pixels on the longest side.

 

Real Estate Agent Vetting

In order for Real Estate Agents to list their personal profiles on Property Pages, they are vetted through the Real Estate Authority’s Disciplinary Database.

Agents will be denied listing if they have been found guilty of Misconduct at any time or, if they have more than one finding of Unsatisfactory Conduct within the preceding 10 years.
